Terms of Trade

These terms of trade provide an overview for the supply of products from Kurow Estate Winery Limited ('we', us', 'our') to the customer ('you', 'your').

 

Order Process
You may order products from us by completing and submitting the order form on this website. You must provide all required information or we might not be able to process your order.

 

The Sale of Alcohol Online

It is illegal for us to sell liquor to anyone under the age of 18, and it is illegal to buy liquor when under the age of 18. It is also illegal to make a false declaration of age in order to purchase liquor.

If you are under the age of 18, please do not attempt to use this site to purchase liquor. By clicking on "Checkout" and completing an order online, you are confirming you are over the age of 18 and legally eligible to purchase liquor.

 

Our discretion in rejecting or accepting orders
We reserve the exclusive right to accept or reject (for any reason whatsoever and in whole or in part) any order submitted by you. If we reject your order (or part of your order), any money paid by you in relation to the rejected part of that order shall be refunded and we shall have no further liability to you in relation to the rejected part of that order.

 

Currency
The prices for the products are stated and are payable in New Zealand dollars (NZD). Any currency conversion will take place online at the rate applicable at the time of purchase.

 

Taxes and other charges
All prices and delivery charges within New Zealand are inclusive of New Zealand Goods and Services Tax at the rate of 15%.

 

Payment
You can pay for your orders using the hosted payment service provided by Direct Payment Solutions {DPS} on behalf of Westpac Bank.

 

Problems with payments
If there is a problem with your payment (for example, if your credit card transaction is declined), we may contact you to make alternative payment arrangements.

 

Debt collection costs
You will be liable for all debt collection costs where you fail to make payment for any order.

 

Availability
All orders are subject to the availability of products. If for any reason a product is not available, we will endeavour to notify the non-availability on this website.

 

Cancellation of orders
Although we have endeavoured to ensure that the product and pricing information provided on this website is accurate, complete, and current, we do not provide any representations or warranties as to its accuracy, completeness or currency of information, and we shall not be responsible or liable for any inaccurate, incomplete, or out-of-date information on this website.
Where products are listed on this website with an incorrect price or with incorrect information, we reserve the right to cancel your order (regardless of whether you have made payment for that order). Where you have already made payment for an order that is subsequently cancelled by us, we will refund the amount paid by you in relation to that order.
You may cancel your order any time prior to our order confirmation. Once we have confirmed your order, you are not able to cancel that order.

 

Dispatch
Once we have confirmed our acceptance of your order, we will endeavour to despatch your order within 3 business days unless a different timeframe is specified in relation to a particular product. If we are unable to despatch your order within this time frame we will endeavour to contact you and advise you of the expected despatch date.

 

Delivery instructions
You may specify delivery instructions for your order (for example, you may authorise the courier to leave the products in a specified location if you will not be at the delivery address). We will not be responsible for any order that is delivered in accordance with your delivery instructions.

 

Post Office Box and Private Bag addresses
We do not deliver to Post Office Box or Private Bag addresses.

 

Delivery costs
Deliveries within New Zealand shall be subject to a standard charge per case (12) of wine. If less than 12 bottles are purchased, you will be charged for the freight of a full case of wine.

Deliveries outside New Zealand are subject to transport charges which will be confirmed in advance of shipment and will be payable in advance, in addition to any charges shown in the shopping cart or other payment windows or price lists.

 

Delivery timeframes and delays
Although we will endeavour to meet delivery timeframes where possible, all delivery timeframes are estimates only and we will not be liable for any loss, expense, or other damage caused by any delay in delivery.

 

New Zealand Deliveries
Deliveries are made by courier throughout New Zealand on a business day to business day basis. Once your order has been dispatched, your order should be delivered within 2-3 days. Please allow up to 3 additional days for delivery to rural addresses.

 

International Deliveries
We currently do not deliver online orders to addresses outside of New Zealand. Should you wish to place an order and are not based in New Zealand please email admin@pasquale.co.nz

 

Refunds and Returns
If you have any concerns as to the condition of the product on delivery please contact our cellar door at admin@pasquale.co.nz to discuss return and or/ refund options.

 

Electronic Transactions Act
You consent to receive communications from us electronically and agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree to be bound by any agreement reached through electronic communications in terms of the Electronic Transactions Act 2002.
